Terms of Service
Last updated: September 7, 2026
These terms set out the agreement between you and Dragon AI Tools when you use this website or our services. By using either, you agree to them.
ON THIS PAGE
1. Acceptance of terms
By accessing this website, submitting a form, or using any Dragon AI Tools service, you agree to be bound by these Terms of Service and by our Privacy Policy. If you do not agree, please do not use the site or the services.
2. What we provide
Dragon AI Tools provides an AI-powered phone answering and lead capture service for small businesses, which may include:
- An automated phone assistant that answers inbound calls you cannot take
- Capture and delivery of caller details and job information
- A lead-conversion or booking web page
- Automated follow-up messaging, where the recipient has consented
- Setup, configuration, and ongoing maintenance of the above
The exact scope of what we deliver to you is defined in the written proposal or order you accept. These terms govern that engagement.
3. Eligibility and accounts
You must be at least 18 years old and able to enter a binding contract. If you are using the services for a business, you represent that you are authorized to bind that business. You are responsible for keeping any account credentials confidential and for all activity under your account.
4. Your responsibilities
- Provide accurate information about your business and keep it current
- Use the services only for lawful purposes and for the business you identified to us
- Do not use the services to send unsolicited, deceptive, harassing, or unlawful communications
- Do not attempt to reverse engineer, resell, or sublicense the services without our written permission
- Do not upload malicious code or attempt to disrupt or gain unauthorized access to our systems
5. Messaging and calling compliance
This section matters more than most people expect, so please read it.
If we send text messages or place calls on your behalf, you are responsible for ensuring you have valid consent from every recipient, and for complying with the Telephone Consumer Protection Act (TCPA), applicable state law, and carrier requirements including A2P 10DLC registration.
- You will not upload or ask us to message any contact who has not given appropriate consent
- You will honor opt-out requests promptly, and you authorize us to honor them on your behalf
- You will provide accurate business information for carrier registration
- You will not use the services for content prohibited by carriers, including messaging related to cannabis, illegal substances, firearms, hate speech, high-risk financial offers, or adult content
We may suspend messaging immediately if we reasonably believe it violates these requirements. Carriers may independently throttle, filter, or block messages, and approval timelines for carrier registration are outside our control.
6. Fees and payment
Fees, payment schedule, and what is included are set out in the proposal or order you accept. Unless that document says otherwise:
- Setup fees are due as scheduled in the accepted proposal
- Recurring fees are billed monthly in advance and renew automatically until cancelled
- Telephone, messaging, and third-party platform usage charges are passed through at cost or as quoted
- Late amounts may pause service until brought current
- Fees already paid for completed work are non-refundable, though we will always try to make a genuine problem right
7. Intellectual property
Dragon AI Tools retains all rights in our software, prompts, call flows, branding, and the Dragon AI Tools name and logo. We grant you a non-exclusive, non-transferable right to use the services for your own business while your account is active.
You retain all rights to your business information, your customer data, and any content you provide. You grant us a limited license to use it solely to deliver the services to you.
8. Third-party services
Our services rely on third parties including telephone carriers, cloud infrastructure, and customer relationship platforms. Their availability, pricing, and policies are outside our control, and their terms may also apply to you. We are not liable for outages, changes, or failures caused by a third-party provider.
9. Disclaimers
The services are provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the automated phone assistant will answer every call, capture every detail correctly, or produce any particular business result. It is a tool that reduces missed calls; it is not a guarantee of revenue, and it is not a substitute for emergency services. Callers with a life-safety emergency should call 911.
10. Limitation of liability
To the fullest extent permitted by law, Dragon AI Tools will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost revenue, or lost business opportunity, even if we were advised such damages were possible.
Our total aggregate liability for any claim arising out of or relating to these terms or the services will not exceed the amount you paid us in the twelve months before the event giving rise to the claim.
Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Indemnification
You agree to indemnify and hold harmless Dragon AI Tools and its owners and contractors from claims, damages, and reasonable legal fees arising from your use of the services, your breach of these terms, or your violation of any law — including, specifically, claims arising from messages sent to recipients who did not consent.
12. Termination
You may cancel a recurring service at any time with 30 days' written notice to dragon@dragonsaitool.com. We may suspend or terminate service for non-payment, for breach of these terms, or where required by a carrier or by law. On termination we will provide a reasonable export of your captured lead data on request.
13. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Riverside County, California, and both parties consent to that jurisdiction.
Before filing anything, both parties agree to first attempt to resolve the dispute in good faith by contacting the other in writing and allowing 30 days to work it out.
14. Changes to these terms
We may update these terms from time to time. The updated date at the top of this page reflects the most recent version. For material changes affecting active customers, we will give at least 30 days' notice by email. Continued use after that period means you accept the updated terms.
